Introduction & Definitions:

Thank you for your interest in the Jewelry Exchange Center. We look forward to being your first and only choice to safely, reliably, and quickly sell your jewelry with the confidence and trust that you will always get the best price. As we strive to be the world leader in the import, export, purchasing, warehousing, sales & distribution of fine jewelry, precious metals, precious stones & gemstones, we owe our success to our customers and appreciate you (herein referred to as "the customer", "our customer", "you") and (possessively as, "your") AGREEING to the following terms and conditions to protect both the customer and Jewelry Exchange Center during the shipping, evaluation, purchase and/or return process. By completing Jewelry Exchange Center's evaluation submission form or participating in any communication with Jewelry Exchange Center, whether written or verbal, on any and all document/s submitted either through our website, verbal contact, email, fax, or any other form of communication, you agree to and our bound to the terms and conditions stated herein including any additional terms and conditions that may be separately stated on other individual documents, forms, and/or submissions in regard to any products/services provided by Jewelry Exchange Center (herein referred to as "JEC") and (possessively as "our").

JEC agrees to handle all of the customer's item/s with the upmost respect and care during the entire evaluation and purchasing process. "The customer" (and all aforementioned variants thereof), shall be herein defined as any person or entity who enters our website and/or enters into any communication with JEC in regard to JEC products/services, regardless of whether or not they decide to submit any items for evaluation. By using our site and/or entering into any communication with JEC, the customer is agreeing to all terms set forth herein. All item/s submitted for evaluation and sale, including all precious metals such as gold, platinum, silver and/or any other precious or semi-precious material not excluding all precious stones or semi-precious stones and/or stone fragments such as diamonds, emeralds, rubies, sapphires, tanzanite, pearls, all gemstones and/or any other precious stone/s, whether individual stones, loose stones, pendants, broken jewelry, inclusive of all pieces and fragments of all submitted precious metals, precious stones and/or any other materials included as part of an evaluation submission will be herein referred to collectively as "jewelry".

Privacy:

At Jewelry Exchange Center, our customer's privacy is always of upmost importance. JEC and its partners/affiliates do not share any customer information with any other company, with the exception of independent grading services, insurance claim processes, or as required by law without the customer's permission. The customer agrees that JEC may contact them via phone or on the email address provided during submission. All information obtained from our customers, whether actively through submission, or passively, are for the sole use of JEC and its affiliates. JEC does not sell your information. All cookies that passively collect any information are used solely to improve the experience of the customer. Most web browsers will allow you to easily block or delete any cookies should you choose not to allow them. It is the responsibility of the customer to ensure the online security of all their personal hardware, software, accounts, etc., and the customer agrees that JEC is not responsible for the security/reliability of the customer's computer hardware/software, including virus software, email account, inbox, 3rd party email software, mail servers, or the responses from the customer's email address in regards to the evaluation/purchasing process with JEC or JEC partners/affiliates. The customer agrees that the information collected can be used to contact the customer from time to time to notify of user updates, service updates, or other information important and relevant to the services provided to the customer by JEC. We may contact you to ensure accuracy of information, and may need additional information to complete your account profile information or submission information. Due to the nature of the services provided, the customer may be required to provide sensitive information such as birth day, photo ID, home address, proof of residence, or other information used to ensure the security of all transactions and services by JEC and its partners/affiliates. Information can be updated with changes per customer request as long as it does not affect any pending transaction or service request with JEC. Additionally, the customer may request that JEC remove, delete, or destroy your private information as long as there is no pending service request or transaction between the customer and JEC. Although this information may be deleted from our active databases, the customer understands that it may remain in our archives. If you have any questions or concerns about JEC privacy policies or the use of your information, feel free to contact one of our representatives.

Additional Disclaimers & Policies:

In some circumstances, it may be necessary to disassemble a piece of jewelry for accurate measurement and grading purposes. No jewelry will be disassembled by JEC or any JEC partners/affiliates without prior consent of the customer. The customer understands that there may be some fees affiliated with different forms of payment, depending on which method of payment is chosen by the customer. JEC is not responsible for any fees incurred as a result of the customer's choice of remittance. Any fees incurred by JEC for the transfer/sending of funds will be the responsibility of the customer and will be deducted prior to remittance. In addition, the customer is responsible for any transfer fees and/or third party fees resulting in the transfer/sending of funds from JEC to the customer.

The customer agrees that it is your responsibility to determine the replacement value of your submission and not the responsibility of JEC and/or JEC affiliates. The customer agrees to the best of their knowledge not to intentionally misrepresent the value, description, quality, weight, carat weight, grade, quantity, or karat rating of any jewelry submitted, and that this information should accurately match the jewelry indicated during their submission request. Keeping in mind that sentimental value is not measurable, the customer agrees that JEC is not responsible for any losses, damages, liabilities or claims resulting directly or indirectly against the customer or against JEC and/or JEC partners/affiliates by the customer, their family members, or any other party through legal action or otherwise in regard to the sale of family heirlooms or items of sentiment. E.g., if your jewelry is of significant sentimental value, JEC urges you to reconsider that item in your submission, as it will be graded on its physical properties, not on its sentiment. The customer understands that all jewelry received by JEC and/or JEC affiliates will be accurately evaluated and recorded, and agrees that the actual results of a physical assessment and evaluation are meant to provide the customer with an accurate weight and grade prior to JEC making any offer for the purchase of your jewelry submission, and are in no way affiliated with the description and values provided by the customer in their original submission. The customer agrees that it is your responsible to use appropriate padding, packaging, double-packaging, and sealing methods to prevent any damage that could occur to your jewelry during shipping to JEC and/or JEC partners/affiliates. JEC and JEC partners/affiliates are not responsible for the loss, damage, or breakage of any jewelry that may occur during the shipping process. In the unlikely event that your package is lost in transit or arrives damaged, JEC will cooperate with all parties during any claims process in effort to assist in the resolution of a claim, which must be filed with the shipping carrier through which the jewelry submission was insured. The customer agrees not to hold JEC or its partners/affiliates responsible for the outcome of any such claim and agrees that JEC and its partners/affiliates are not responsible for any losses resulting from the outcome of that claim. Furthermore, the customer understands and agrees that the insurance value and description/s they enter in their submission to JEC and/or JEC partners/affiliates are to accurately reflect the submitted jewelry and total replacement value for the sum of all jewelry included in their submission. During any claims process, the customer understands that the insurer of the customer's shipment may contact JEC and/or JEC partners/affiliates to confirm the estimated value of your submission or the circumstances of your claim. The customer agrees to allow JEC and/or JEC partners/affiliates to communicate to the insurer any results of an evaluation, and the customer understands that the insurer may use that information in conjunction with your claim. The customer understands that any attempt to defraud JEC and/or JEC partners/affiliates, the insurance provider, or to break any governing state, federal, or international laws will not be tolerated, and that JEC and/or JEC partners/affiliates will fully cooperate with the insurer, law enforcement, and all involved parties regarding any evidence or misrepresentation of the customer's submission, including the jewelry's value, description, quality, weight, carat weight, grade, quantity, karat rating, etc. (or the lack thereof).

Jewelry Exchange Center takes great pride in being one of the worlds' most reputable buyers in the jewelry industry. By contacting JEC, any JEC partners/affiliates, and/or entering into ANY discussion, inquiry, negotiation, or agreement regarding any product/service with JEC or its partners/affiliates, you agree that you will only submit/sell items that belong to you. You as the customer agree to accept full responsibility for any and all item/s that you submit/sell through our service, and are bound to all applicable governing state, federal, and international laws and any penalties/consequences for violation of such laws. The customer understands and acknowledges that the sale of stolen property, property that is not free from liens, secured interests, encumbrances, as well as the sale of any property that was taken without authorization from a rightful owner is a violation of state, federal, and international law. JEC will notify and fully cooperate with law enforcement in regard to any attempts to sell any unauthorized item or stolen property through JEC's services, and will fully support law enforcement during any investigation and prosecution of any person or entity attempting to sell unauthorized or stolen property. All amounts paid by JEC for any items found to be unauthorized or stolen will be repaid to JEC by the customer in its full entirety, plus a service charge of 1.5% per month accrued since the originating date of payment, with all reasonable court costs, attorney fees, and any affiliated costs of collection being the responsibility of the customer. The customer agrees to hold harmless JEC and any of its officers, employees, representatives, partners, and affiliates, including Gemological Grading Services (GGS), for any loss, liability, damage or claim related to the shipping, evaluation, purchase/sell, and/or return of your items, as well as any loss, liability, damage or claim related to the attempted sale of any unauthorized or stolen property. JEC and its partners/affiliates have no liability toward visitors of our site who do not choose to use our services. JEC's liability to the customer and users of our services are governed by applicable law. JEC and its partners/affiliates will not be liable for compensatory, incidental, indirect, consequential, or damages of any kind without limitation that may result from the use of, or inability to use our site. Exclusions, limitations, and disclaimers on our site and elsewhere on any documents related to all communications and submissions with JEC apply to the extent of applicable governing law.

JEC and its partners/affiliates appreciate our customers and the opportunity to do business with them. We work hard to develop long-lasting relationships with our clients and always appreciate their business. Our policies help assure the proper ethics and professionalism expected by our buyers, our sellers, our importers, exporters, and of course by you, our valued customer. Please be aware that all policies, terms and conditions set forth are established for the protection of all parties involved, including the 3rd party shipping companies and any affiliated services provided through independent 3rd party providers such as GGS, UPS, UPS Capital, etc. To ensure the appropriate protection of all parties, JEC Policies, Terms & Conditions are subject to change without notice.

SEVERABILITY:

In the event that any word, phrase, clause, sentence or other provision hereof shall violate any applicable statute, ordinance or rule of law in any jurisdiction in which it is used, such provision shall be ineffective to the extent of such violation without invalidating any other provisions hereof.
